1. Program Overview


The Hyundai Resale Value Protection ("RVP") Program provides eligible customers with a protection future value when trading in an eligible Hyundai Stargazer for a new Hyundai vehicle, subject to these Terms and Conditions and the final approved program rules.


The Program is designed to support customer confidence in future vehicle value and facilitate a smoother upgrade to a new Hyundai vehicle. The Program is a conditional trade-in support program and not a deposit-taking, lending, insurance, cash investment or unconditional vehicle buyback arrangement.


2. Program Provider and Participating Parties


• The program provider will be the Hyundai entity identified in the final customer enrollment form ("Hyundai Malaysia" or "HMY").


• Applications may be handled through authorized participating Hyundai dealers.


• Vehicle inspection, financing settlement, custody, auction and remarketing activities may be conducted by designated third-party partners.


• Third-party participation does not remove the customer’s obligation to satisfy all Program requirements.


3. Eligible Vehicles


• The Program applies only to Hyundai Stargazer vehicles, or other models formally announced by HMY.


• The vehicle must be new and originally purchased from an authorized participating Hyundai dealer in Malaysia.


• The vehicle identification number must be registered in the Program at the time and in the manner specified by HMY.


• Demonstrator, pre-owned, parallel-import, commercial-fleet, rental, ride-hailing or other excluded vehicles are not eligible unless HMY expressly approves them in writing.


4. Exercise Period and Protection Value


Year 3


• Exercise Window: 25-36 months


• Maximum Mileage: Below 60,000 km


• Protection Value: 70%


Year 4


• Exercise Window: 37-48 months


• Maximum Mileage: Below 80,000 km


• Protection Value: 60%


Year 5


• Exercise Window: 49-60 months


• Maximum Mileage: Below 100,000 km


• Protection Value: 50%


Draft parameter notice: The periods, mileage limits and percentages above are proposed parameters and are subject to final HMY approval and the customer enrollment document.


The Protection Value will be calculated using the base amount stated in the customer enrollment form. Unless expressly stated otherwise, the base amount excludes insurance, road tax, registration fees, financing charges, late-payment charges, accessories, optional equipment, after-market modifications, rebates, incentives and other promotional benefits.


5. Customer Eligibility


• The customer must be the registered owner throughout the applicable ownership period.


• The vehicle must not have been sold, assigned, transferred or beneficially transferred to another person.


• The customer must exercise the Program only within the applicable exercise window.


• The customer must purchase and register a new eligible Hyundai vehicle through a participating dealer as part of the same approved trade-in transaction.


• The customer must provide complete, current and accurate documents and information requested by the dealer, HMY, the financing institution and the inspection partner.


6. Service, Maintenance and Parts Requirements


• All scheduled maintenance must be carried out on time at authorized Hyundai service centers in Malaysia.


• The customer must retain complete service, repair and maintenance records.


• Hyundai genuine parts, or any alternative parts expressly approved by HMY, must be used.


• The vehicle must be maintained in accordance with the owner’s manual, warranty requirements and applicable laws.


• Failure to comply with service or maintenance requirements may result in rejection or adjustment of the application, subject to the final approved Program rules.


7. Vehicle Condition Requirements


The vehicle must pass the final inspection arranged by HMY or its designated inspection partner. The vehicle must be roadworthy, legally registrable and in reasonable condition, allowing only fair wear and tear appropriate to age and mileage.


7.1 Potential Exclusions


• Accident damage, structural or chassis damage, or total-loss history.


• Flood, fire or material natural-disaster damage.


• Odometer tampering, replacement without approved records, or mileage inconsistency.


• Unauthorized structural, performance, electrical or safety-related modifications.


• Missing keys, registration documents, service records or material vehicle components.


• Material misuse, illegal activity, competition use, rental, ride-hailing, or commercial use not approved under the Program.


• Any condition that prevents lawful title transfer or sale.


8. Inspection and Final Eligibility


• Initial document acceptance does not constitute final approval.


• Final eligibility is confirmed only after document review, financing verification and vehicle inspection.


• HMY or its partner may request additional documents, photographs, diagnostic checks or a supplementary inspection.


• If rectification is permitted, the customer must complete it within the period stated by HMY and at the customer’s own cost unless otherwise agreed in writing.


• HMY may reject an application that does not satisfy the approved Program requirements, provided the decision is made consistently with applicable law and the customer contract.


9. Outstanding Financing and Negative Equity


At the time of vehicle handover, the verified outstanding financing settlement amount must not exceed the applicable Protection Value, unless the customer first pays the shortfall and the financing institution confirms the revised amount.


Verified Outstanding Financing ≤ Protection Value


If the verified outstanding financing exceeds the Protection Value:


• the customer must settle the excess amount before vehicle handover; or


• the RVP exercise will not proceed.


The Program guarantees an eligible vehicle value, not the customer’s loan balance. HMY does not assume negative equity, late-payment charges, arrears, early-settlement fees or any other financing liability unless expressly stated in the final customer contract.


10. Application and Vehicle Return Process


1. The customer submits an RVP application through a participating dealer.


2. The dealer informs the customer of the required documents.


3. The customer submits complete documents to the dealer.


4. The dealer forwards the application to HMY.


5. HMY reviews the documents and may request supplementary information.


6. If the document review is approved, HMY requests an inspection from the designated inspection partner.


7. The inspection partner arranges and conducts the inspection with the customer.


8. If the vehicle passes inspection and financing requirements are met, the customer hands over the vehicle to the inspection partner.


9. The inspection partner settles the verified outstanding financing directly with the financing institution in accordance with the approved settlement process.


10. HMY and the participating dealer settle the approved RVP Benefit.


11. The participating dealer applies the approved RVP Benefit as a discount or trade-in credit toward the purchase of a new eligible Hyundai vehicle.


10A. Obligation to Complete the New Vehicle Purchase


The RVP Program is intended solely to facilitate the customer's purchase of a new eligible Hyundai vehicle.


Following vehicle handover to Hyundai's designated inspection partner, the customer must complete the purchase and registration of a new eligible Hyundai vehicle within thirty (30) calendar days from the vehicle handover date.


If the customer fails to complete the new vehicle purchase within thirty (30) calendar days, the customer shall reimburse HMY for:


• Any shortfall between the outstanding financing amount settled on behalf of the customer and the net proceeds recovered from the vehicle disposal process;


• Vehicle inspection costs;


• Transportation and logistics costs;


• Auction and remarketing fees;


• Storage costs;


• Administrative and processing costs; and


• Any other reasonable costs directly incurred in connection with the RVP exercise.


Extension Due to Hyundai-Related Delays


Where the delivery of the new Hyundai vehicle is delayed due to circumstances attributable to Hyundai, including but not limited to:


• Production delays;


• Supply shortages;


• Shipping delays;


• Port or customs delays;


• Dealer allocation constraints; or


• Other Hyundai-related operational reasons,


HMY may extend the purchase completion period for up to an additional ninety (90) calendar days.


During such extension period, the customer shall not be subject to any reimbursement obligation arising solely from the Hyundai-related delay.


The RVP Program shall not be considered exercised until the customer completes the purchase of a new eligible Hyundai vehicle.


11. RVP Benefit Calculation and Use


Subject to final approval, the customer-facing net value available toward the new Hyundai purchase will be calculated as follows:


Customer Net RVP Value = Protection Value − Verified Outstanding Financing


The commercial cost borne by HMY, if any, will be determined separately based on the Protection Value, actual auction or remarketing proceeds, agreed partner fees and the final settlement rules. The customer must not treat HMY’s internal cost as an additional customer benefit.


11.1 Example


• Protection Value: RM70,000


• Verified Outstanding Financing: RM55,000


• Customer Net RVP Value: RM15,000


• The approved RM15,000 is applied toward the purchase of the new eligible Hyundai vehicle, subject to the final invoice and settlement process.


11.2 Permitted Use


• Trade-in credit, down-payment support or purchase-price discount for a new eligible Hyundai vehicle.


• Not redeemable for cash.


• Not transferable to another person.


• Not usable toward a non-Hyundai vehicle.


• Not combinable with other campaigns unless HMY expressly permits it.


12. Market Value and Auction Proceeds


The inspected market value and auction proceeds may be higher or lower than the Protection Value. The treatment of any amount above the Protection Value, and any fees or deductions relating to auction, storage, transport, inspection, repairs, title transfer or settlement, must be expressly stated in the final enrollment form and partner agreements.


No sales consultant, dealer employee or partner may promise a final auction value or final RVP Benefit before completion of the approved review, inspection and settlement process.


13. Documents Required


• Completed RVP application form.


• Identity and contact documents required by applicable law.


• Registration and ownership documents.


• Original financing settlement statement or redemption letter from the financing institution.


• Complete authorized Hyundai service and repair records.


• Insurance and accident records, where requested.


• Both vehicle keys and any security devices.


• Other documents reasonably required to verify eligibility, lawful title, settlement and transfer.


14. Customer Representations and Cooperation


• All information provided is true, complete and not misleading.


• The customer has disclosed all accidents, damage, repairs, modifications, financing, encumbrances and ownership changes.


• The customer authorizes reasonable verification with dealers, service centers, financiers, insurers, government bodies and appointed partners, subject to applicable law and privacy notices.


• The customer will cooperate with inspection, title transfer, financing settlement and vehicle handover.


15. Personal Data and Privacy


Personal data will be collected, used, disclosed, retained and protected in accordance with the applicable Malaysian data-protection requirements and the final HMY privacy notice. The customer should receive clear notice of the purposes of processing, categories of recipients, retention approach, contact channel and available rights before enrollment.


HMY should obtain any consent or authorization required for sharing information with participating dealers, financing institutions, inspection partners, auction or remarketing operators and service providers.


16. Fraud, Misrepresentation and Abuse


• HMY may suspend review or reject a claim involving forged documents, mileage manipulation, undisclosed damage, collusion, duplicate claims, unlawful title or material misrepresentation.


• HMY may recover an improperly paid benefit and refer suspected unlawful conduct to the relevant authorities, subject to applicable law.


• A rejection under this section does not limit any other contractual or legal rights.


17. Program Changes, Suspension and Termination


HMY may amend, suspend or terminate the Program prospectively, subject to applicable law and any rights already granted under a signed customer enrollment contract. Material changes affecting enrolled customers should be communicated through the channel and notice period specified in the final contract.


18. Limitation and Clarification of Program Scope


• The Program does not guarantee that future open-market or auction prices will remain stable.


• The Program does not guarantee approval if the customer or vehicle fails any requirement.


• The Program does not guarantee full financing settlement where the verified outstanding financing exceeds the Protection Value.


• The Program does not require HMY to purchase the vehicle directly unless expressly stated in the final contract.


• Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded under Malaysian law.


19. Complaints and Dispute Resolution


The final version should state the customer-service contact details, complaint-handling process, expected response channel, escalation route and any dispute-resolution or jurisdiction clause approved by Malaysian legal counsel. Customers should retain copies of all application documents, inspection results and settlement statements.


20. Governing Documents and Priority


The signed customer enrollment form, approved Terms and Conditions, privacy notice, inspection standard and final transaction documents together govern the Program. If there is any inconsistency, the order of priority must be stated in the final customer contract. Dealer explanations and marketing materials do not override the signed Program documents.


21. Customer Acknowledgement


• I understand that the RVP Program is conditional and subject to final document review and vehicle inspection.


• I understand that the Program guarantees an eligible vehicle value and does not guarantee my outstanding financing balance.


• I understand that I must settle any financing amount above the Protection Value before the RVP exercise can proceed.


• I understand that the approved benefit may only be applied toward a new eligible Hyundai vehicle and is not payable in cash.


• I confirm that I have read and understood the approved Terms and Conditions and privacy notice.
