Terms of Use

Definitions:
These Terms govern use of the Malaysian website operated by Hyundai Motor Malaysia Sdn. Bhd. They do not replace the Privacy Policy, a vehicle purchase agreement, a warranty or separate terms for a particular service.

1. Website operator and application

The website at www.hyundai.com/my (Website) is operated for Hyundai Motor Malaysia Sdn. Bhd. (HMY, we, us or our). Please read these Terms before using it. By using the Website you agree to the terms applicable to that use, to the extent recognised by law. Where express acceptance is required for a feature or transaction, we will obtain it separately.

The Privacy Policy governs how HMY processes personal data. Accepting these Terms does not constitute consent to optional marketing, profiling or another activity requiring separate permission. You may read our privacy information or contact us to exercise your rights without agreeing to optional marketing.

Specific terms apply to purchases, warranties, campaigns, test drives, connected services or other activities where provided. For the particular activity, applicable specific terms prevail over these general Website Terms to the extent of inconsistency. Neither overrides mandatory law or a privacy right.

2. Eligibility and acting for others

You must have the legal capacity and any required authority to make a transaction or binding request. Persons below 18 should use transactional or account features only with appropriate parent or guardian involvement and subject to any applicable age restriction. You must not impersonate another person or submit a request without authority.

3. Product information, specifications and prices

Website descriptions, images, specifications, colours, equipment and availability relate to the model, variant, market and period stated. Images may show optional equipment or another market’s specification where identified. Confirm the specific Malaysian vehicle and included equipment in the relevant quotation or purchase documents.

Prices, promotions and estimates apply on the basis, dates and conditions stated. We will identify applicable taxes and material exclusions or additional charges where required. Financing illustrations are estimates, not approval or a binding offer. Changes to future offers do not retrospectively change an accepted transaction.

We take reasonable care over Website information and may correct errors or update future information. A correction does not automatically entitle HMY or a dealer to cancel a binding contract or remove a remedy for a misleading representation. Statutory consumer rights remain unaffected.

4. Enquiries, bookings and online transactions

A request for a quotation, test drive, appointment or information is ordinarily an enquiry, not acceptance of a vehicle order or confirmation of availability. An automated acknowledgement confirms receipt only unless it expressly confirms a binding booking or acceptance. The relevant seller or provider will confirm the applicable arrangement.

If online ordering or payment is offered, the relevant transaction terms will identify the seller, price and charges, payment process, acceptance point, fulfilment, cancellation and refund conditions. You will have an appropriate opportunity to review and correct information. These Terms do not create an online sale process that is not offered or displace applicable electronic-commerce requirements.

Make payments only through verified channels identified for the transaction. Contact HMY or the named seller independently if payment instructions appear suspicious. We will not ask you to disclose a password or one-time passcode to us through an unsolicited message.

5. Authorised dealers and other suppliers

An authorised dealer may be an independent business and the contracting seller or service provider for your transaction. Check the legal entity identified in the quotation, order, invoice or service agreement. Dealer authorisation does not, by itself, authorise a dealer to vary HMY’s obligations or make commitments in HMY’s name.

Dealers independently determine their retail prices and dealer-funded offers, subject to applicable law and any properly applicable campaign conditions. HMY’s publication of recommended prices or national campaigns does not guarantee identical dealer offers. This section does not exclude HMY’s own contractual obligations or statutory responsibilities as distributor, manufacturer or supplier where applicable.

6. Finance, insurance and third-party programmes

Information about financing, insurance, roadside assistance, charging or other third-party programmes is general information, subject to the named provider’s eligibility, underwriting, coverage, fees and contract terms. Unless expressly stated in a separate applicable arrangement, HMY is not the financier, insurer or issuer of that third-party product. Website information is not personalised financial or insurance advice.
Any referral or disclosure of personal data to such a provider remains subject to the Privacy Policy and applicable permission. You are not required to agree to unrelated marketing merely to make an enquiry.

7. Warranty, technical and safety information

Warranty coverage and service entitlements are governed by the applicable warranty documents, transaction terms and non-excludable law. These Website Terms do not reduce them. General maintenance or technical information is not a diagnosis of a particular vehicle; seek assistance from an appropriately qualified provider where needed.

Use a vehicle, charging equipment and connected features in accordance with applicable law, relevant manuals and safety instructions. Published fuel-consumption, range, charging or performance figures should be read with their stated testing basis and conditions; actual results may vary. Nothing in this section excuses inaccurate or misleading statements or limits mandatory product-safety obligations.

8. Intellectual property and permitted use

Website text, designs, software, photographs, videos, logos and other protected material belong to HMY, relevant Hyundai entities or their licensors. You may view the Website and make reasonable copies for personal, non-commercial use or for a legitimate transaction, retaining ownership notices.

Unless authorised or permitted by law, you must not reproduce or commercially exploit substantial protected content, misuse trademarks, reverse engineer protected software or create a misleading impression of affiliation. These restrictions do not prevent lawful quotation, fair dealing, accessibility use, regulatory reporting, legal proceedings or preservation of evidence.

9. Acceptable use and account security

Do not introduce malicious code, bypass access controls, attempt unauthorised access, interfere with services, harvest another person’s data, submit unlawful or fraudulent material, or use automated access that unlawfully extracts protected content or materially disrupts the Website. Lawful criticism and genuine complaints are not prohibited.

If an account is provided, keep access details secure, provide reasonably accurate information and notify us promptly of suspected compromise. We will not automatically treat every action through a compromised account as authorised by you. Responsibility depends on the facts and applicable law.

10. Information and material you submit

Submit only information or material you are entitled to provide and reasonably believe to be accurate. Do not include unnecessary personal data or third-party confidential information. We may reject or remove unlawful or harmful submissions, without obstructing a genuine complaint or lawful request.

You retain ownership of your submitted material. You permit HMY and providers acting on our behalf to use, copy and communicate it only to the extent reasonably necessary to handle your request, provide the relevant service, comply with law or resolve a dispute. Any separate public marketing use requires an appropriate permission or other lawful basis; this clause is not a blanket publicity release.

11. External websites and services

Links or integrations may lead to independently operated websites or services with their own terms and privacy practices. A link does not by itself mean that HMY endorses all content or assumes the provider’s obligations. We remain responsible for our own representations, selection and conduct to the extent required by law.

12. Availability, changes to features and suspension

We use reasonable efforts to maintain the Website but do not promise uninterrupted access or that every feature will always be available. We may maintain, modify or suspend a feature where reasonably necessary for security, legal compliance, material misuse or operational reasons, providing notice where reasonably practicable.

Restrictions should be proportionate and should not remove an accrued transaction right, obstruct a statutory remedy or prevent a privacy request through another available channel. Where a paid service is affected, its applicable terms and mandatory law govern any alternative performance or refund.

13. Responsibility and non-excludable rights

Nothing in these Terms excludes or restricts a right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Consumer Protection Act 1999 or the PDPA. Nothing excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or other liability that applicable law does not permit us to exclude.

Subject to section 13.1, HMY is not responsible for loss that is not caused by its breach of duty, or that was not reasonably foreseeable from that breach. For a person using the Website for business purposes, and only to the extent lawful and reasonable, HMY excludes indirect or consequential business losses and loss of profit, revenue or business opportunity arising solely from general Website use. This does not limit liability under a separate transaction, our personal-data obligations or a non-excludable consumer remedy.

If you deliberately misuse the Website unlawfully, you remain responsible under applicable law for loss you cause. We do not impose an unlimited consumer indemnity or require you to compensate us for our own wrongdoing. HMY retains lawful remedies for unauthorised access, fraud and infringement.

14. Changes to these Terms

We may amend these Terms prospectively and publish the revised version and effective date. We provide reasonable notice of material changes where appropriate and seek further acceptance where required. Revised terms do not retrospectively alter an existing purchase, accrued right, complaint or privacy choice. Changes to a separately contracted service follow its applicable terms and law.

15. Governing law, disputes and general provisions

These Terms are governed by Malaysian law. Malaysian courts have non-exclusive jurisdiction, subject to any mandatory jurisdiction or applicable statutory forum. Nothing prevents you from approaching the Tribunal for Consumer Claims Malaysia where it has jurisdiction, the Personal Data Protection Commissioner, another competent regulator or another forum available by law.

If a provision is unlawful or unenforceable, it applies only to the extent lawfully enforceable, or is severed where necessary, without removing mandatory protections. The remaining provisions continue where they can operate independently. A delay in exercising a right is not a waiver. These Terms do not create a partnership or agency relationship with a Website user.

These Terms are available in English and Bahasa Malaysia; both are intended to have the same meaning. Please notify HMY of a discrepancy so that it can be clarified without reducing mandatory consumer or privacy rights.
