Hyundai Motor Group Innovation Center Singapore ("HMGICS") Terms and Conditions for Visitors

Application

  1. These terms and conditions , together with any other applicable specific terms and conditions, policies and rules, which may be issued by Hyundai Motor Group Innovation Center Singapore("HMGICS") from time to time (including any updated or revised versions) (together, the "T&C") govern your (as a Participant (defined below)) use of HMGICS' website for the reservation of the HMGICS Discovery Tour (defined below), your participation of the Discovery Tour or any part thereof.
  2. By checking "I accept the Terms & Conditions" during reservation for the HMGICS Discovery Tour on HMGICS’ Discovery Tour reservation page (“SevenRooms”) or during “check-in” at HMGICS, you confirm that you and for all persons (including minors) for whom you are making reservation or checking in for or on behalf of or otherwise secure benefits through this registrations (each a "Party"), have read and understood, accept and agree to be legally bound by the T&C which forms a legally binding agreement between you and HMGICS. When you accept these T&C for and on behalf of others, you represent that you have all necessary rights and consents to agree to these T&C on behalf of the other Parties. If you and/or the Party do not agree to the T&C, HMGICS is unable to conduct the Discover Tour for you and/or the Party, and you shall leave the relevant webpage(s) and do not proceed to make reservations for or check-in to the Discovery Tour.
  3. Participant refers to any Party, person or entity who successfully registers for a slot and/or joins in the Discovery Tour at HMGICS, whether or not such persons complete the full agenda of the Discovery Tour or part thereof ("Participant"). For the avoidance of doubt, where the registration for the Discovery Tour is made by one person on behalf of other persons, "Participants" also include such other persons, regardless of whether such other persons' names and information are submitted to HMGICS. "Participants" shall include any person who attends the Discovery Tour but later decides not to continue with the Discovery Tour for any reasons.
  4. HMGICS' Discovery Tour consists of the following:
    1. Smart Farm Tour;
    2. Factory Virtual Reality ("VR") Tour;
    3. IONIQ Lounge Tour;
    4. Skytrack Experience;

may include any other experiences, tours, and activities that HMGICS include from time to time.

Section A: General Terms

  1. The Discovery Tour is open to all members of the public, subject to these T&C. However, any participant under the age of 18 must be accompanied by an adult (above 18 years old).
  2. The Discovery Tours are arranged and scheduled in groups, and Participants acknowledge and understand that HMGICS may conduct the Discovery Tour with other Participants who reserved for the same group time slot. A Participant can register for the Discovery Tour on behalf of a maximum of 5 other Participants for the same group time slot. The maximum number of Participants in each group time slot is determined at HMGICS’ discretion.
  3. A Participant may be able to cancel the Discovery Tour reservation at any time up to 1 hour before the start of the selected Discovery Tour date.
  4. HMGICS reserves the right to amend, vary or revise the T&C at any time and without prior notice to the Participants. Any amendments, variations or revisions so given shall be binding on the Participants as from the start of the Discovery Tour, should they decide to continue participating in the Discovery Tour. If a Participant disagrees with the amendment, variation or revision of the T&C, the Participant shall not join in the Discovery Tour.
  5. HMGICS reserves the right to alter or cancel part or the whole of the Discovery Tour without prior notice to the Participants, and at any time for any reasons, which may include undesirable weather conditions, health and safety concerns, other ongoing activities or HMGICS Events within the HMGICS premise.
  6. HMGICS will use reasonable efforts to inform the Participants of any changes, postponements or cancellations of the Discovery Tour. However, depending on the reason of the change, postponement or cancellation, HMGICS is unable to guarantee that all Participants will be informed before the Discovery Tour appointment time. Participants are advised to check their emails and/or the HMGICS website for any notifications of change or announcements regarding the Discovery Tour.
  7. The Discovery Tour will be conducted in English language only. Participants understand and acknowledge that there will be no translation services or subtitles throughout the entirety of the Discovery Tour.
  8. Individuals under the age of 18 ("minors") must be accompanied by a responsible adult, parent or legal guardian over (and including) the age of 18. The responsible adult, parent or legal guardian warrants that he/she has obtained, or has the capacity to give, parental consent on behalf of the accompanying minors, and acknowledge and agree that the minors are under their care, and they are responsible for the minor's conduct, as well as their compliance with and liability under these T&C.
  9. In the event that any minor is denied entry to HMGICS premises or participation in the Discovery Tour for any reason, the responsible adult, parent or the legal guardian shall ensure the safety or care of the minor, and should not leave them unattended at any time.
  10. To the best of its ability, HMGICS has prepared the Discovery Tour in a manner that is accessible to all Participants, including Participants with visual or aural disabilities or difficulties in mobility. Participants should assess whether the nature of the activities at the Discovery Tour is suitable for his/her conditions before participating in any of the activities throughout the Discovery Tour.
  11. Reservations for the Discovery Tour are not for sale and are not exchangeable for cash.
  12. Participants are responsible for the accuracy of the details on their confirmed Discovery Tour. HMGICS bears no responsibility or liability should there be any error in the Participants' reservation details.
  13. The Discovery Tour will begin at the scheduled time and Participants will not be allowed to join in the tour 15 minutes after it has begun.
  14. Participants who arrive late for their reserved Discovery Tour may participate in the Discovery Tour as long as it is within the first 15 minutes grace period of the Discovery Tour. However, missed portions of the Discovery Tour will not be repeated. If Participants arrive 15 minutes late after the start of the Discovery Tour, their reservation will be automatically cancelled, and they will not be admitted to participate in the Discovery Tour. They may be allotted to another time slot (where available and possible) or asked to make a reservation for another day or other available slots on the HMGICS website.
  15. The Discovery Tour will run for approximately 90 minutes, and Participants will be required to walk or move from point to point and participate in the various activities within HMGICS premises. Participants agree and understand that their participation in the Discovery Tour, or any part of activity thereof, is entirely voluntary and based upon their own initiatives. Participants may, at any time, stop participating in the activities of the Discovery Tour if they assess that the nature of the activity is not suitable for them.
  16. Participants (and the minors under their care and charge) understand, agree and acknowledge that participation in the Discovery Tour requires Participants to be in a fit and good physical condition and is not suffering from medical conditions that may impact or affect the health and safety of the Participant(s). Participants should only participate in the Discovery Tour if they are fit, in good health and physical condition, and not suffering or experiencing any medical conditions which may affect or preclude his/her judgments in any of their safe participation in any activities. Participants also understand that for safety reasons, Participants who are pregnant, with pre-existing health conditions (such as but not limited to high blood pressure, hypertension, heart conditions or post-surgeries conditions), or are wearing casts, may not be permitted to participate in the Discovery Tour.
  17. Participants are responsible for their own health and safety during the Discovery Tour. While participating in the Discovery Tour, if the Participant(s) feel unwell or have any abnormal breathing, sweating, dizziness or any other concerns regarding their physical or health conditions, the Participant shall take all the necessary steps and precautions during the Discovery Tour to inform the HMGICS staff on-duty immediately, including but not limited to, opting to be excluded from certain activities, or seeking medical attention on his or her own accord.
  18. Participants agree to comply with all signs, notices, policies, instructions or requests of HMGICS, and acknowledges that HMGICS reserves its rights to suspend or cancel any Participants' access and/or participation in any part of the Discovery Tour, or any part of the HMGICS premises, for violating any of HMGICS' signs, notices, policies, instructions or requests which, in HMGICS' sole opinion, poses any threat, security or safety issues or will cause any social disorder at HMGICS premises arising from any unsafe, reckless or careless conduct (potential or otherwise)before, during or after the Discovery Tour, or if HMGICS considers that the circumstances so require to maintain the order within the HMGICS premises.
  19. Participants acknowledge that during the course of the Discovery Tour, photographs, audio and video recordings of Participants may be taken for security, marketing, promotional or advertising purposes. Such photographs, audio and video recordings will be the exclusive property of HMGICS, and Participants agree to the use of the same by HMGICS (or their affiliates or representatives) for promotional, marketing, or advertising purposes, including publishing such photographs or recordings on publicly available websites and social media, without any remuneration, payment or compensation. For further information on the use of the Participants' personal data, kindly refer to the HGMICS Privacy Policy on HMGICS website.

Prohibited Activities

  1. Participants should note that the following are not allowed on HMGICS premises:
    1. Smoking, vaping or consuming illegal drugs
    2. Dangerous or illegal items, including but not limited to items that may become flammable, hazardous or dangerous
    3. Purchasing, selling, distributing, exhibiting or promoting any items other than those available for sale by HMGICS
    4. Consumption of outside food (cooked or otherwise) which are not purchased from HMGICS premises
    5. Undesirable conduct or activities that may or are likely to cause nuisance, disturbance, public disorder, done for illegal or immoral purposes, and/or may cause damage or injury to HMGICS (including injury to HMGICS' reputation), HMGICS' directors, officers, employees, agents or contractors of HMGICS, and other Participants of the Discovery Tour
    6. Any act of outraging public decency, harassment or assault
    7. Unauthorised filming, photographing or recording at restricted or security controlled areas
    8. Unauthorised filming, photographing or recording for commercial purposes
    9. Pets
    10. Remote-controlled aerial devices such as drones
  2. If HMGICS reasonably believes that any of the Participants is carrying any dangerous or illegal items which may harm, or endanger others, or cause public disorder, the Participant may be subject to a search of their possession (including bags and clothes) at any time within HMGICS premises.
  3. If a Participant is found to have violated clause 20, and/or HMGICS is of the opinion that the Participant and/or the Participant's group is/are disruptive or is / are suffering from a contagious disease, HMGICS reserves the right to take the following actions with immediate effect, and without compensation:
    1. void the Participant(s)' reservation;
    2. remove the Participant(s) from the Discovery Tour;
    3. terminate the Participant(s)' visit and remove the Participant(s) from HMGICS' premises;
    4. confiscate any dangerous, suspicious or illegal items; and/or
    5. report to the relevant authorities where appropriate.

Security

  1. The parking area on HMGICS premises is managed by an external parking vendor. Users of the parking area are deemed to contract separately with the parking vendor. Users understand and acknowledge that they are parking at their own risk, and acknowledge that HMGICS does not bear any responsibility or liability for the safety, security or condition of the parking area including the vehicles parked at the parking.
  2. As HMGICS is primarily a research and development facility, public access is restricted to permitted areas only. Participants in the Discovery Tour are only allowed to access the permitted areas under the supervision of the dedicated HMGICS staff or its authorised contractors during the Discovery Tour. Participants found to have accessed the restricted area(s) without authorisation knowingly or unknowingly, intentionally or unintentionally, within the HMGICS premises, may be liable for trespassing and will be handed over to the authorities, and subject to punishments under the laws, as the case may be.
  3. Participants are generally permitted to take photography, audio and video recording of the permitted areas during the Discovery Tour for non-commercial purposes, subject to these T&C, and any instructions or guidance provided by the HMGICS prior or during the course of the Discovery Tour.
  4. Participants acknowledge that the HMGICS' premises are under surveillance of close circuit television ("CCTV"), the CCTV footage containing the Participant's image identity may be kept or submitted to the authorities upon request and/or where necessary for security reasons.
  5. Participants are required to register or “check-in” on-site before they are allowed to participate in the HMGICS Discovery Tour. This tour registration or “check-in” may be performed through an appointed third-party service provider. When doing so, Participants are required to show the email confirmation of their Discovery Tour reservation details to the HMGICS staff or its authorised contractors before the start of the Discovery Tour for verification. Participants may be denied entry if they fail to produce any form of verification details or the information provided during registration does not match the reservation details. Participants may check the HMGICS Privacy Policy regarding how their personal data is being collected, used or disclosed.
  6. As mentioned in paragraph 21 above, Participants may be subject to a search, including bags, clothes and other possessions at any time if HMGICS reasonably believes that the Participants carry any dangerous, suspicious or illegal items within HMGICS premises. In addition, HMGICS reserves to right to conduct a search on the Participants, and their possessions, if there is, in HMGICS' sole opinion, a reasonable cause to believe that the Participants misappropriate or cause to appropriate any items belonging to HMGICS or any other Participants without authorisation. Any items that are prohibited or belong to HMGICS that are discovered during the search will be seized or confiscated (either temporarily or otherwise) and where appropriate, the Participant whom the seized or confiscated items belong to, will be handed over to the relevant authorities for further investigation.

    HMGICS reserves the right to refuse access to, the participation of, or to remove any participant(s) as it deems necessary. This may include participant(s) whose conduct is disorderly, inappropriate, who is intoxicated or poses a threat to safety and security or the enjoyment of the Discovery Tour by other Participants.
  7. Participants are required to wear the visitor labels provided by HMGICS at all times. Failure to do so may result in Participants being removed from or denied entry and participation from the Discovery Tour.
  8. Participants are responsible for the care of their own belongings during the entirety of the Discovery Tour, and understand that HMGICS is in no way responsible for ensuring the safety of their belongings. Participants agree not to hold HMGICS liable for any loss or damage that they may suffer.

Vehicles on Display

  1. During the Discovery Tour, Participants are given the opportunity to view, interact with, and ask questions about the vehicles on display at the display areas.
  2. Participants agree and acknowledge that as the vehicles on display are actual vehicles capable of being driven, Participants are to exercise caution, and to use and interact with the vehicles on display in a safe and responsible manner, and to take reasonable care in so doing (e.g. opening or closing of the doors, adjusting of seats) to avoid personal injury, as well as damage to the vehicles, as far as possible. In the event of any confusion or uncertainty regarding the interactive signs, display indications or what should or should not be done, Participants are advised to check with the HMGICS staff or its authorised contractors and not to proceed without the instructions and guidance of HMGICS staff or its authorised contractors.
  3. Participants acknowledge and agree that while they are permitted to test out certain functions of the vehicles on display, the vehicles on display should not be driven (i.e. the accelerator should not be used, nor the parking brake be released). Participants are advised to check with the HMGICS staff on the vehicle functions that they can test or experience.
  4. Subject to paragraphs 68 to 73 below (Indemnification and Limitation of Liability), Participants agree that they are not allowed to remove or cause to remove any objects, items, parts or tools from the vehicle on display knowingly or unknowingly, intentionally or unintentionally without HMGICS' consent. Participants acknowledge that they are solely and fully responsible and liable for any injury arising from their negligent, careless, irresponsible, deliberate or reckless use of the vehicle on display.
  5. Subject to paragraphs 68 to 73 below (Indemnification and Limitation of Liability), if any injury arise from the use or misuse of the vehicle on display as stated at paragraph 34 above, the Participant(s) involved agree to hold HMGICS harmless against all and any losses, claims, proceedings, damages, liabilities (whether joint or several), deficiencies, costs, expenses, actions, judgments, settlements, interest, awards, penalties, or fines.

IONIQ Lounge

  1. IONIQ Lounge consists of the Test Drive experience, consultation room, Hyundai Collections & Accessories area, and the Electric Vehicle ("EV") Handover & Collection area ("IONIQ Lounge").
  2. During the Discovery Tour, Participants are given the opportunity to view and interact with the exhibits at the Hyundai Collections & Accessories area, primarily the items on display such as car models, vehicle parts, clothing, accessories and the interactive touchscreens displays. Participants agree and acknowledge that while they are permitted to touch and interact with the various exhibits, they are not permitted to remove any exhibits from its original position or cause to remove or misappropriate any exhibits from the IONIQ Lounge without HMGICS' authorisation.
  3. Participants also agree and acknowledge that any damage or harm caused to any of the exhibits as a result of, in connection with or arising from any act, omission, or misconduct of the Participants shall be borne solely by the Participant(s).
  4. As the IONIQ Lounge may be visited by potential customers and is adjacent to the EV Handover & Collection area, Participants acknowledge and agree not to:
    1. intervene or disrupt the vehicle handover and collection process of the customers;
    2. interfere, distract or cause nuisance to other Participants, visitors, customers who are at the IONIQ Lounge; and
    3. interfere with the ongoing tours of other visitors, Participants or customers.

Smart Farm

  1. The Smart Farm tour consists of several segments: (a) a walking tour of HMGICS' Level 1 and Level 3 open space, (b) the harvesting room, and (c) the Tasting Lounge.
  2. Participants are prohibited from entering the Smart Farm operations space such as seeding, transplanting, growing and back-end harvesting operations space ("Smart Farm Prohibited Areas") unless with the written permission from HMGICS. The HMGICS staff guiding the tour is not authorized to grant such permission on behalf of HMGICS, whether verbally or in writing.
  3. Participants acknowledge and understand that they should not interact with the heavy autonomous machinery or any equipment at the Smart Farm Prohibited Areas unless with express permission and authorization by HMGICS.
  4. At the harvesting room, Participants will be given the opportunity to (1) extract the greens from the growing towers; (2) pack and keep their harvested greens; and (3) decorate the packing bags for their harvested greens. Participation in the entire harvesting process is highly encouraged but voluntary.
  5. During the extraction process at the harvesting room:
    1. Participants are advised to follow HMGICS staff's instructions and guidance demonstrating how to extract the greens from the growing towers.
    2. As the extraction process involves the use of force in pulling the greens out of the growing towers, Participants are advised to exercise care in doing so, such as wearing disposable gloves provided to protect their fingers, ensuring that their surroundings are clear before performing the extraction, and to avoid hitting others when doing so.
    3. If the Participants face any difficulty in extracting the greens, they should inform and seek help from the HMGICS staff.
  6. Participants may be asked to temporarily deposit their harvested greens in the holding areas as a group before continuing with other tour activities. Participants understand that they should properly label, pack, identify or distinguish their harvested greens using the materials provided. Participants agree that HMGICS shall bear no responsibility for the loss or misplacement of any harvested greens. Participants will also not be allowed to harvest other greens beyond the allotted quantity for that session.
  7. Participants also understand and acknowledge that the materials provided (such as markers, highlighters, stickers and tape) are HMGICS’ property and should not be removed from the harvesting.
  8. At the Tasting Lounge, Participants are given the opportunity to consume harvested greens. While Participants are encouraged to participate in the consumption of the harvested greens, they may opt out of the activity.
  9. While HMGICS endeavours to ensure that the greens in the Smart Farm are planted, cultivated and harvested in a clean, hygienic and safe environment, and that the greens are safe for consumption, Participants shall not hold HMGICS liable for any losses, damages, costs, injuries, claims or liabilities arising whatsoever from the consumption of the greens (either harvested at the Smart Farm or the Tasting Lounge).
  10. The harvested greens provided will be labelled such that Participants are informed of the type of greens that are provided. If the Participants have any allergies or are sensitive to consuming raw vegetables, Participants are responsible for checking with or informing the relevant HMGICS staff or its authorised contractors, and should not proceed with the tasting experience. Participants are also highly encouraged to wash the harvested greens before consumption, and agree not to hold HMGICS liable for any losses damages, costs, injuries, claims or liabilities arising whatsoever from said consumption. Participants acknowledge that they are consuming the harvested greens at their own risk.
  11. HMGICS does not guarantee the freshness and quality with regard to the taste of the harvested and consumed greens and may change the types of greens for tasting and harvesting at any time without notice.

Factory Virtual Reality ("VR") Tour

  1. The Factory VR Tour, or VR Tour in short, allows Participants to tour the Smart Factory through the VR environment via the VR headset provided by HMGICS. This is an entirely voluntary activity which Participants may opt out of if the Participants do not wish to proceed with the activity.
  2. As the VR Tour provided by HMGICS may vary from other VR experiences, at the start of the VR Tour, the HMGICS staff will conduct a briefing, present a tutorial video to guide the Participants on how to put on, operate and take off the VR headset provided. Participants are required to listen to and follow all set up, operating instructions and safety warnings given by HMGICS while putting on, wearing, and removing the VR headset. Any discomfort, injuries, damages, losses and costs incurred as a result of misuse or mistreatment of the VR headset shall solely be borne by the Participant, including but not restricted to the costs of replacing a VR headset.
  3. The Participants acknowledge that the VR Tour (including the VR content and VR headsets) are property of HMGICS and are provided for use to the Participants during the VR Tour only. The Participants shall operate, use and maintain the VR headset in a reasonable and responsible manner as advised by HMGICS, and agree not to damage, misuse or mistreat the VR headset intentionally or unintentionally, and without instructions of HMGICS. Any attempt to modify, destroy or vary the settings of the VR headset, dismantle and/or remove any parts or components of the VR headset without any instructions or directions from HMGICS is prohibited, and any damage, losses, or repair resulting from the Participant’s actions shall be borne by the Participant, including any penalties under the relevant laws.
  4. Given the nature of the VR headset, Participants wearing spectacles may experience slight discomfort when putting on the VR headset. Participants acknowledge that HMGICS is unable to provide any alternative VR headsets for Participants who are wearing spectacles, and Participants may choose to wear VR headset with or without spectacles throughout the VR tour. In the event that Participants opt to wear spectacles with the VR headset throughout the VR tour, Participants agree that they are doing so out of their own choice and volition, and HMGICS is not responsible or liable for any damage or harm done to the Participants' spectacles as a result of wearing the VR headset.
  5. Given the highly immersive nature of VR environments, Participants in the VR Tour may experience motion sickness, nausea, eye strain, disorientation, vertigo, seizures, general discomfort, headaches, anxiety, or other physical, mental or health-related other related symptoms. Participants acknowledge and understand that:
    1. Participation in the VR Tour by minors below the age of 13 is on a voluntary basis, and the accompanying adult(s) or legal guardian agree and acknowledge the terms and conditions hereunder on behalf of any such minor under their care. The accompanying adult(s) or legal guardian agree that they are responsible for supervising the minor and the minor’s participation in the VR Tour, including any health, physical and safety issues that may arise from said participation.
    2. Throughout the entirety of the VR Tour, the Participants should not stand up nor attempt to move about except in accordance with instructions given by HMGICS staff or its authorised contractors, or as part of the VR Tour itself
    3. If the Participant(s) are pregnant, elderly, have vision abnormalities, have psychiatric disorders such as seizures or epilepsy, suffer from a heart condition or any other medical and health conditions, the Participants should consult a medical doctor before participating in the VR Tour or choose not to take part in the VR Tour.
    4. If the Participants are unwell or recently recovered from an illness, the Participants are advised not to take part in the VR Tour.
    5. If any of the Participants experience any of the abovementioned symptoms or discomfort in any form during the VR Tour, the Participants should inform the HMGICS staff or its authorised contractors and remove the VR headsets immediately.
    6. If any of the Participants experience any of the abovementioned symptoms or discomfort in any form after the VR Tour, the Participants should inform HMGICS staff or its authorised contractors, and pause their participation in the remaining activities of the Discovery Tour. Should their symptoms not alleviate within 10 minutes or any reasonable time for recovery, Participants are advised to seek medical treatment at their own costs.
    7. Participants consent to, and agree for HMGICS to take all steps it considers reasonably necessary to protect Participants' welfare in the event of personal injury or where there are health or safety concerns, including the administration of any emergency medical treatment and ambulance transportation.
    8. Participants are ultimately responsible for monitoring and assessing their own health conditions prior to, during and after the VR Tour.
  6. While HMGICS endeavours to provide the best possible VR experience for Participants, errors or glitches may arise during the individual Participant(s) VR Tour, leading to a pause in, disruption of, or early end to the Participants' VR experience. As there are limited VR headsets available for use in each run of the Discovery Tour, Participants acknowledge that HMGICS is not able, nor is HMGICS obliged, to provide a replacement VR headset during the same VR Tour, or to allow the Participants to join another Discovery Tour or VR Tour without a prior reservation for the same experience.
  7. The Participants may be given the opportunity to view the interior of the smart factory through VR or otherwise. Participants are not allowed to photograph, film or record the interiors of the Smart Factory, unless with the express approval from HMGICS staff present.
  8. Participants acknowledge and understand that HMGICS has taken all reasonable measures to ensure the proper construction and maintenance of its facilities and equipment, and has taken all reasonable precautions in providing its services. However, the VR Tour may contain inherent risks and hazards, which may not be eliminated without jeopardizing the essential qualities of the VR Tour. Any participation in the VR Tour, use or misuse of the VR Tour facilities or equipment involves a significant risk to Participants. Such risks could include, but are not limited to, cuts and bruises, falls, broken bones, injuries to face, arms legs, ankles banks, heads and necks, injuries from contact with other Participants, spinal injuries, other serious injuries, and permanent disability if the Participants deviate from the standard instructions for use of the VR headset given by HMGICS. Participants further agree to participate in the VR Tour at their own risks, and expressly assume and accept all risks in relation thereto.
  9. In addition, Participants acknowledge and understand that the VR headsets are not designed or manufactured by HMGICS, and HMGICS bears no responsibility or liability for any faults with, the quality or, or any issues with the VR headsets, save where any fault or issue with the VR headsets arise from HMGICS' negligence in the maintenance of the VR headsets.

Skytrack Experience

  1. As part of the Discovery Tour, the Skytrack Experience includes the Skytrack Lounge and Skytrack which allows Participants to ride a HMGICS-produced vehicle as passengers on the Skytrack (the "Skytrack Experience"). This is an entirely voluntary activity, and Participants may opt out if the Participants do not wish to proceed with this activity. Participants will be required to sign the Skytrack Experience Consent Form(s) before the start of the Skytrack Experience. Where the Participant is a minor, the accompanying adult or the legal guardian is responsible for signing the consent and waiver form on behalf of the Participant.
  2. Prior to the Skytrack Experience, the HMGICS will conduct a briefing and guide the Participants, through verbal, visual and audio instructions or other forms of communications, regarding the participation in the Skytrack Experience, including but not limited to a safety briefing and rules on riding in the vehicle. Participants are required to adhere to and follow all instructions, briefing, guidance and rules given by HMGICS for the safety and wellbeing of the Participants and other passengers (including the driver) in the HMGICS vehicle. Participants may be denied participation in the Skytrack Experience should HMGICS assess that the Participant is uncooperative, intends to or is likely to flout, or disobey any of the instructions, briefing, guidance or rules given, which may lead to an unsafe Skytrack Experience to the Participants and other passengers (including the driver) in the HMGICS vehicle.
  3. As the Skytrack Experience involves driving at a certain speed around the Skytrack, the Skytrack Experience may be cancelled or postponed if HMGICS assess and determine that it is unsafe to drive on the Skytrack (e.g. if the Skytrack is wet or obstructed). Participants acknowledge and understand that HMGICS' decision is final, and are deemed to have agreed to HMGICS' decision should there be any changes, such as a postponement or cancellation of the Skytrack Experience.
  4. Given the nature of the Skytrack Experience, only Participants who satisfy the following requirements may participate:
    1. must be at least 100 centimetres in height (for Participants below 135 centimetres in height, a booster seat will be provided);
    2. must not be under the influence of alcohol or non-prescribed drugs;
    3. must not be pregnant;
    4. must not be using any respiratory equipment on a daily basis; and
    5. must not be suffering from any health conditions, physical infirmities, conditions, illnesses or disabilities making it unsafe for Participants to be exposed to high speed, non-level driving, or centrifugal forces of around 3.0G.
  5. Participants agree to abide by the following rules during the Skytrack Experience:
    1. Participants may only participate in the Skytrack Experience in groups of a maximum of 3 persons at any one time per ride.
    2. Participants are to obey all instructions from HMGICS, including the driver of the vehicle.
    3. Consumption of food and drinks are not allowed within the vehicle.
    4. Seatbelts must be worn at all times inside the vehicle.
    5. Participants are not permitted to open the windows or doors of the vehicle at any point, unless instructed by HMGICS.
    6. Any loose items should be secured within the HMGICS vehicle. Otherwise, Participants shall not bring such items into the HMGICS vehicle.
    7. Participants are not permitted to intervene or interfere with the driving of the HMGICS vehicle at any point in time (e.g. distracting the driver, interfering with the controls of the vehicle).
    8. Participants are to treat HMGICS staff, its authorised contractors and driver with respect and follow all instructions given by the driver during the Skytrack Experience ride.
    9. Should Participants experience any discomfort, dizziness, pain or headaches, etc, they are to inform the HMGICS staff or its authorised contractors immediately.
    10. Participants are to avoid any dangerous activities or actions that may endanger or cause injury to others.
    11. Minors may only participate in the Skytrack Experience whilst being accompanied by the responsible adult, parent or legal guardian.
  6. Participants agree to, and acknowledge that the Skytrack Experience may be stopped immediately and/or cancelled (either for that Participant in particular or the Skytrack Experience in its entirety) in the event that HMGICS assesses that (i) there is an actual or potential breach of the abovementioned rules; (ii) the Skytrack or the vehicle is unsafe for driving; or (iii) there is any other reasons, in HMGICS' sole opinion, which necessitate the stopping or cancellation of the Skytrack Experience. Subject to HMGICS' discretion, Participants may not be given another opportunity to participate in the Skytrack Experience and will be required to book for another Discovery Tour session online via the HMGICS website.
  7. Participants acknowledge and understand that the breach of any of the abovementioned rules may result in damage, injury, loss, costs, or liabilities arising from damages (to the vehicle up to a total replacement of the vehicle) or injuries sustained (by the Participants, HMGICS and driver, or any other party) as a result of the said breach. Participants agree to abide by the indemnification and limitation of liability paragraphs at paragraphs 68 to 73 below, as well as in the waiver form signed.
  8. Similar to the VR Tour experience, Participants consent to, and agree for HMGICS to take all steps it considers reasonably necessary to protect Participants' welfare in the event of personal injury or where there are health or safety concerns, including the administration of any emergency medical treatment and ambulance transportation.

Indemnification and Limitation of Liability

  1. By registering for and participating in the Discovery Tour, Participants agree to assume all risks in respect of loss, damage and/or injury to their property / person (and anyone else whom they are responsible for) and be liable for any cost or expense incurred arising from such loss, damage and/or injury, including costs incurred by HMGICS when administering the necessary emergency medical treatment should a need to do so arise.
  2. Participants also acknowledge that they may be liable to other Participants for their injuries, as well as any damage caused to any part of the HMGICS premises, property or the Discovery Tour, if such injuries and damages arise from their irresponsible, deliberate or reckless behaviour.
  3. Where Participants are responsible for minors participating in the Discovery Tour (whether as a parent, legal guardian, custodian or otherwise), Participants agree to be bound by these terms and conditions, as well as any and all waivers and liabilities, and consent, to the same on the minor's behalf. Participants supervising minors agree and acknowledge that they are to take full responsibility for the minor's safety (including adhering to any safety measures instructed by HMGICS), and undertake to supervise the minors at all times while on HMGICS' premises and throughout the Discovery Tour. Participants acknowledge that HMGICS does not assume any responsibility for the care, charge and supervision of unaccompanied minors on HMGICS premises and during the Discovery Tour, who shall remain the sole and full responsibility of the parent, legal guardian or person having charge of the minor.
  4. To the fullest extent permitted by applicable laws, HMGICS shall not be liable for any losses, damages, costs, expenses, injuries, claims, liabilities resulting from or caused by any unusual or unforeseeable circumstances beyond the control of HMGICS, including but not limited to fire, leakage of steam, electricity, gas, water, or rain from the breakage, leakage, obstruction, or other defects or pipes, sprinklers, wires, appliances, plumbing, air conditioning, or lighting fixtures, or from theft, vandalism, earthquake, act of God, or from any other cause.
  5. To the fullest extent permitted by applicable laws, HMGICS shall not be liable to any persons for any injuries, losses, damages, claims, costs and expenses in respect or, in connection with, and/or arising from the Discovery Tour, or use of HMGICS property and equipment, visits to HMGICS premises, or any part thereof.
  6. To the fullest extent permitted by applicable laws, Participants shall fully indemnify and hold harmless HMGICS from and against all claims, demands, actions, judgments, losses, damages, costs, liabilities or expenses (including reasonable legal and attorney fees) of any nature, whether direct or indirect, which HMGICS may suffer or incur for any death, injury, accidents, loss or damage caused by the Participant's negligence, act or omission in connection with or arising from the Participant's (including the minors under his/her care) entry to and participation in the Discovery Tour, use of HMGICS equipment and property, visits to HMGICS premises, and the Participant's non-compliance with any of these T&C.

HMGICS Events

  1. HMGICS may from time to time:
    1. organise, participate and/or collaborate with third parties such as government agencies, academics institutions or any corporations to market, promote, support and participate in certain activities at HMGICS premises that may include the Discovery Tour;
    2. organise, participate and/or collaborate with charitable organisations or communal societies to demonstrate its corporate social responsibilities; collectively known as ("HMGICS Events").
  2. Participants understand and agree that HMGICS may from time to time introduce additional terms and conditions in conjunction with the HMGICS Events. If the Participants are invited through the HMGICS Events to participate in the Discovery Tour or are attending the HMGICS Events, the Participants are deemed to have accepted these additional terms and conditions introduced by HMGICS or its corporate partners in addition to the T&C.

Admission Fees

  1. For the public Discovery Tour, all reservations should be made through the official HMGICS website which links to the SevenRooms platform only. Reservations made through any other third parties may not be accepted, and HMGICS shall not responsible for nor entertain any such reservation. Please note that HMGICS does not ask for your payment details nor collect admission fees for the public Discovery Tour.
  2. For corporate tours, reservations are to be made on a separate link on HMGICS’ website, and the reservation is only confirmed upon successful payment of a non-refundable admission fee of Singapore Dollars Three Hundred (S$300.00) only per tour. A portion of the admission fee will be donated to the charity organisation determined by HMGICS after deducting the permissible administrative expenses. For the avoidance of doubt, the Participation Fee is non-refundable even in situations of no-show or cancellation of the corporate tours. The admission fee is not eligible for any tax deduction whatsoever. The recommended size of each corporate tour is 18 participants, but depending on the circumstances, HMGICS has the discretion to determine the maximum number of participants in each corporate tour.
  3. The admission fees are non-transferrable and non-refundable. In the event the Participants are unable to attend any of the reserved corporate tours, the admission fees will be forfeited. At the discretion of HMGICS, HMGICS may consider allowing the Participants to postpone the corporate tour to another date/time slot, subject to the availability and other considerations.

Intellectual Property Rights

  1. Participants understand and agree that the names, graphics, logos and/or marks of HMGICS including the design of the building and premises are trademarks and intellectual property owned by HMGICS and/or its licensors, and no use, copy, distribution, public display, or creation of any derivative work thereof is permitted.

Data Privacy

  1. By registering for and participating in the Discovery Tour, Participants understand and agree to the collection, use, processing, and disclosure of their personal data in accordance with HGMICS Privacy Policy

Governing Law and Jurisdiction

  1. These T&C shall be governed by and interpreted in accordance with the laws of the Republic of Singapore. The Courts of Singapore shall have exclusive jurisdiction over any disputes arising from these T&C, including the validity and enforceability thereof.

Severability

  1. Any provision stated herein which is held to be illegal, invalid or unenforceable by a court or tribunal with competent jurisdiction, will be ineffective solely to the extent of such illegality, invalidity or unenforceability, without affecting the other provisions herein which shall remain in full force and effect, and will be deemed to be amended as necessary to give effect as close as possible to the intent and purposes of the illegal, invalid or unenforceable provision.

Miscellaneous

  1. The Participants shall not assume any ownership of the Confidential Information of HMGICS including its intellectual property rights showcased during the Discovery Tour. The Participants further acknowledge that there is no transfer of any intellectual property rights nor will any license or right of the intellectual property be granted to the Participants during the Discovery Tour.
  2. At no point shall any relaxation, forbearance, delay or indulgence by HMGICS in enforcing any of the T&C shall prejudice, affect, or restrict HMGICS' rights and discretions hereunder nor shall any waiver by HMGICS or any breach hereof operates as a waiver of any continuing breach hereof.
  3. In the T&C, references to "HMGICS" include its officers, directors, employees, agents, contractors, affiliates, successors and permitted assignees.
  4. HMGICS reserves all rights to amend, supplement, delete, vary or replace any of the T&C without notice to the Participants. Participants are deemed to have accepted the revised terms without any actions required.

Section B: For HMGICS Kids Workshop

  1. This Section sets out the specific terms and conditions for all workshops or events under the HMGICS Kids Workshop.
  2. To the extent applicable, the HMGICS Discovery Tour Terms and Conditions shall apply to the workshops or events under the HMGICS Kids Workshop, and the Participants' use of the HMGICS' building and its facilities. For the avoidance of doubt, where applicable, references to the "Discovery Tour" in the Discovery Tour Terms and Conditions shall include a reference to the HMGICS Kids Program (and any workshops or events organised as part of the HMGICS Kids Program).
  3. In the event of any conflict between the terms of this Addendum and the Discovery Tour Terms and Conditions, the terms of this Addendum shall prevail.

HMGICS Kids Workshop

  1. The HMGICS Kids Workshop refers to any workshop conducted by HMGICS and/or its partners, contractors or agencies (collectively, the "Organisers") within the permitted areas of the HMGICS Customer Experience space under the HMGICS Kids Program. These workshops are designed to promote innovation, sustainability and awareness of HMGICS' core values and operations through interactive, educational and experiential activities for children.
  2. Participation in the various Kids Program workshops is restricted to certain age groups and requires consent from a parent or legal guardian, and supervision from a parent, legal guardian and/or responsible adult:

  3. Parents, legal guardians or responsible adults must register / check-in for their child / ward prior to the start of each workshop. Unattended minors will not be allowed to participate in any of the activities on HMGICS premises.
  4. It is recommended for the parent and/or, legal guardian and/or responsible adult to supervise the Participants and not to leave the Participants unattended during the Kids Program. When the Organisers are conducting the tasting session in the Smart Food Lab with the Participants, the parent, legal guardian and/or responsible adult shall supervise and remain within reachable distance at all times to provide immediate response to the Participants in situations where, for example, the Participants develop an adverse reaction during the tasting session. While the SPOT Robot Coding does not involve any consumption of food, minimal supervision is recommended to ensure the Participants do not damage the equipment or cause harm to others with the equipment provided.
  5. The HMGICS Kids Program will be conducted in groups, with the number of Participants in each group varying depending on the nature and content of the workshop(s). HMGICS and/or the Organisers reserve the right to (a) set a maximum capacity for each session; (b) conduct the workshop with other Participants; and (c) proceed with the workshop without any prior notice of group composition or changes in the itinerary or agenda.
  6. Participation in the HMGICS Kids Program is subject to availability and requires pre-registration online through the links provided on HMGICS' website. A non-refundable Participation Fees per Participant is required for reservation of the HMGICS Kids Program. For reservations with more than three participants, please contact visitus@hmgics.com.
  7. The Participation Fee shall be paid at the time of reservation. A portion of the Participation Fee will be donated to the charity organisation determined by HMGICS after deducting the permissible administrative expenses. For the avoidance of doubt, the Participation Fee is non-refundable even in situations of no-show or cancellation of the HMGICS Kids Program in part or in whole. The Participation Fee is not subjected to any tax deduction whatsoever.
  8. The parent, legal guardian and/or responsible adult of the Participants are responsible in ensuring the Participants shall not be left unattended in HMGICS premises at all times, even if the Participants are not attending any of the HMGICS Kids Program.
  9. By registering for the HMGICS Kids Program, Participants, their parent(s), legal guardian and/or responsible adult acknowledge that before, throughout or after the Kids Workshop(s), photographs, audio and video recordings of Participants may be taken for security, marketing, promotional or advertising purposes (such as for the presentation of the HIMGICS Kids Program souvenir to the Participants at the end of the session). Such photos, audios and videos assets will be the exclusive property of HMGICS, and Participants agree to the use of the same by HMGICS (or their affiliates or representatives) for promotional, marketing, or advertising purposes, including publishing such photographs or recordings on publicly available websites, notice boards and social media, without any remuneration, payment or compensation. For further information on the use of the Participants' personal data, kindly refer to the Privacy Policy on HMGICS website.
  10. The activities conducted during the HMGICS Kids Workshop - Smart Food Lab may include hands-on activities involving food preparation, handling and tasting by the Participants. While the Organisers endeavour to ensure that reasonable care will be taken to ensure food safety and hygiene, Participants and their parent, legal guardian and/or responsible adults are aware that certain risks cannot be excluded and agree not to hold the Organisers liable for any losses, damages, costs, injuries, claims, or liabilities arising whatsoever from the consumption or handling of the food, foodborne illnesses, or food allergies.
  11. [Smart Food Lab] It is the responsibility of the Participants, their parent, legal guardian and/or responsible adults to inform the Organisers of any known food allergies or dietary restrictions prior to the commencement of the workshop. By participating in the HMGICS Kids Program including any other workshops or events organised as part of the HMGICS Kids Program, the parent, legal guardian and/or responsible adult and on behalf of the Participants, acknowledge and agree that the Organisers shall not be held liable for any allergic reactions, illnesses or adverse effects that may result from any such activities that are being conducted as part of the HMGICS Kids Program.
  12. [SPOT Robot Coding Workshop] The Spot Coding Workshop involves the use of customised technical equipment such as programmable robots, devices or other materials owned by HMGICS or its contractors (“Device”) to achieve the workshop’s purposes, and the Organisers shall conduct a briefing and give instructions to the Participants on how to set up and operate the Device. Participants, their parent, legal guardian and/or responsible adult acknowledge that by registering for and participating in the Spot Coding Workshop, Participants are liable for any damages or loss to the Device provided for use during the Spot Coding Workshop, including but not limited to the costs of replacing the Device or any parts thereof, save where such damage or loss occurs in the course of normal usage (such as without excessive force or intentional damage), and fair wear and tear, or due to the negligence, act or omission of the Organisers. Participants acknowledge that HMGICS and/or the Organisers reserve the right to replace the Device with any other models of similar function or equipment with equivalent specifications without notice at any time before the start of the SPOT Coding Workshop.
  13. To the extent permitted by law, HMGICS disclaims all risks, liabilities and claims relating to or in connection with the participation by the Participants in the HMGICS Kids Program. HMGICS and/or the Organiser’s maximum aggregate liability limit relating to or in connection with the participation of HMGICS Kids Program by the Participants, in whole or in part shall be Singapore Dollars One Thousand (SGD1,000) only.
